Upcycle Counseling, LLC (UCL) and Mary Beth Weisel, LCSW (also considered part of UCL) respect your privacy and will never sell your information. UCL does not collect, disclose, or give your information away without your permission. When you interact with UCL and Mary Beth Weisel via phone, email, in person, or use HIPAA compliant websites such as Mary Beth’s Business Zoom platform, Psychology Today and Headway who have business agreements with UCL, you automatically give UCL and those entities permission to use your information for mental health purposes such as notifications, appointment setting, intake paperwork, appointments, record keeping and billing. You also are in agreement to UCL and continuity of care third party sharing. Those who are considered “Continuity of Care” entities include, but are not limited to: insurance, your primary care physician and/or psychiatrist, your caregiver- if you have one, family members (should you give a separate consent), emergency services if needed and other healthcare entities who need information to assist in your care. Before info is shared between UCL and 3rd parties, efforts will be made to inform you to assure your consent in sharing information. Should you have any explicit exemptions to this notice, you must share them both verbally and in writing to assure agreement between both you and UCL or UCL will be assumed there are none. Further, your information will be shared if you have a physical or mental health crisis and need emergency services through 911 or an admitting hospital to assure your safety and care. Your medical record information could be shared if it is court ordered as well.
You have a right to request your medical record information after you sign a release of information (ROI) form. 3rd parties can request information about you using an ROI, such as your legal representative. You have a right to know details about who, what, and when your information was requested and then released by UCL upon your written request. In rare circumstances, if reading your medical record information would further cause you serious mental harm, it will not be shared with you before discussing with my legal representation.
Exceptions within HIPPA compliance: including divulging substance use and any known medical conditions or information like, but not limited to, demographics and weapon possession- needed to save a lives- and as follows: If you mention active “suicidal” or “homicidal” ideations or actively display intentions of endangerment to yourself and/or others; or if discussing past or present harm to either minors or older adults- by law, and for safety purposes, necessary information will be shared with dedicated law enforcement authorities such as 911, and Indiana’s equivalent of Adult and/or Child Protective Services/DCS to assist you and others.
